Terms of Service
Effective: January 1, 2026 — Upstream Intelligence, Inc.
1. Overview
These Terms govern your use of the Upstream Data private preview at data.upstream.cx and any synthetic artifacts you access from Upstream Intelligence, Inc. ("Upstream", "we", "us"). By accessing the site or preview artifacts, you agree to these Terms.
2. Public samples
Public sample artifacts are publication-gated. The applicable license, row limit, attribution requirement, and redistribution terms are the terms attached to the specific approved sample artifact. Commercial datasets and paid-depth artifacts are never covered by public sample terms.
3. Private preview access
Preview artifacts are licensed for internal evaluation within the approved organization. You may:
- Evaluate and test AI/ML models
- Test RCM software, clearinghouse integrations, and clinical workflows
- Build and demo prior auth automation systems
- Create internal notes, evaluation reports, and design-partner feedback
You may not:
- Resell, sublicense, or publicly redistribute the raw dataset files
- Represent the data as real patient records or real claims data
- Use the data to identify or re-identify any real individual
- Submit PHI, raw claims, customer operational exports, or clinical free text
Production certification, enterprise SLAs, broad redistribution rights, and self-serve paid fulfillment are reserved for a later commercial release after legal/operator approval.
4. Zero PHI guarantee
All datasets are synthesized from statistical priors and payer behavior rule models. No real patient records enter the synthesis pipeline. You acknowledge that the data is entirely synthetic and agree not to rely on it as representing the records or experiences of any real individual or organization.
5. Refunds
Private preview access is manually approved and may be revoked. If you have a technical issue with preview delivery, contact data@upstream.cx within 7 days.
6. Disclaimer
Datasets are provided "as is" for development and testing purposes. They do not constitute clinical advice, legal advice, or regulatory guidance. Upstream makes no warranty that the denial patterns reflect current payer policy for any specific health plan.
7. Governing law
These Terms are governed by the laws of the State of Texas. Disputes are subject to the exclusive jurisdiction of the courts of Dallas County, Texas.
